Education Legislation Amendment Act 2016

The Education Legislation Amendment Act 2016 (the Act), came into effect on 29 October 2016.

It amends several Acts, including some parts of the Education Act 1989, and makes improvements to the administrative and governance arrangements for educational entities and funding organisations. These changes are different to the proposals currently being consulted on to update the Education Act 1989. 

The public policy objectives of the Act are to:

  • strengthen existing legal regimes to make them more effective and efficient
  • modernise out-of-date legislation so it remains  relevant, effective, and fit for purpose
  • address situations where, over time, the law has become inconsistent with practice or has given rise to practical difficulties
  • address omissions in the law.
